What Are the Most Common Legal Issues for Women in the Workplace?
Women face a wide range of challenges on the job, including:
- Unequal pay—Women are often paid less than male co-workers for the same work with the same level of training, education and experience
- Unfair treatment because of pregnancy or child-bearing capability—Women are often denied access to career development, raises, promotions, assignments and other benefits because of perceptions that they will either want time off to bear a child or will terminate their employment when they become pregnant
- Sexual harassment—Though men can be victims of sexual harassment, the vast majority of victims are women, who are subjected to both quid pro quo sexual harassment and work environments that are hostile because of inappropriate sexual touching or contact, comments, jokes, photos, videos, etc.
What Is the Process for Protecting Your Rights as a Woman in the Workplace?
When you believe that you have been wrongfully treated at work because you are a woman, you should immediately notify your employer. Document everything that has happened in writing and provide copies to your boss, as well as your human resources department.
The sooner you retain legal counsel, the better, as you’ll have an advocate who can be your intermediary with your employer. Your lawyer will advise you of your options for pursuing a claim, including the benefits of immediately filing a lawsuit in court or first filing a complaint with a government agency, such as the Division of Human Rights or the Equal Employment Opportunity Commission. Once your complaint is submitted to the agency, there will typically be an investigation of your claims. If the agency finds that your claims have merit, they may work directly with your employer to resolve the matter. That may include:
- Compensation for unequal pay, unfair treatment or denial of raises/promotions
- Requirement that your employer amend or revise employment policies
- Reinstatement of your job, if you were wrongfully terminated or chose to quit because of intolerable conditions
Can You File a Civil Lawsuit against Your Employer If Your Rights as a Woman Have Been Violated?
Yes, but depending on your circumstances, your attorney may advise first filing a complaint with the EEOC or Division of Human Rights. In New York, a complaint must be filed with the EEOC within 300 days of the wrongful act or with the Division of Human Rights within 3 years of the wrong.
