UNPAID SPREAD-OF-HOURS PAY EMPLOYEESs

Romero PLLC has filed a class action lawsuit alleging that the Bolla Market failed to pay its employees earning the minimum wage an additional hour of pay when they worked a shift longer than 10 hours from its start to its finish, including breaks, as required by the New York Miscellaneous Industries Wage Order, 12 N.Y.C.R.R. § 142.

The Romero Law Group PLLC has filed a lawsuit on behalf of restaurant workers against the Irish Coffee Pub in East Islip, New York. The lawsuit alleges that the restaurant failed to pay proper overtime wages to its servers, bussers, food runners and bartenders, as well as its kitchen workers, such as cooks and dishwashers. The lawsuit also alleges that the restaurant failed to pay one additional hour’s pay when workers worked a day that was longer than 10 hours. In addition, the lawsuit alleges that the restaurant improperly paid its workers a “tipped rate” because it failed to provide workers with written notice of its intent to take a tip credit. The case seeks to recover unpaid overtime wages, minimum wages, “spread-of-hours” pay, statutory damages liquidated damages, attorneys’ fees, and costs.
